TERMS OF SALE

The purchase of tickets for the FORMULA 1 CANADIAN GRAND PRIX (the “Event”) is subject to these terms of sale (the “Terms of Sale”).

By purchasing a ticket for the Event (the “Client”), you agree to be bound by these Terms of Sale.

Please also review our Terms and Conditions [hyperlink] on Bell GPCanada’s Website (collectively, “BELL GPCANADA,” “we,” “us,” or “our”) to learn more about the terms of use for the use of our Website, as well as our Privacy Policy to learn more about how we handle your personal information [hyperlink].

1 – Interpretation

In the event that there is any inconsistency between a provision of these Terms of Sale and a provision in the corporate brochure or reservation form (if applicable), the provision contained therein will prevail.

The representation of the Event, including the circuit, grandstands, corporate suites, giant screens as well as any other element related to the Event, as it appears on any ticket, pass, corporate brochure or on the Event’s official website, may not be complete and should be used for reference purposes only.

In the present Terms of Sale, as well as in any other provision contained in the corporate brochure or in the reservation form, the expression “Hospitality Suites” shall be interpreted and understood as including the different Suites or Villas, including, without limiting the generality of the foregoing, the Elite Suites & Restaurant, Podium Suites & Club, Senna Club, Privilege 12, Platine Chalet, Toundra, Wall of Champions and any other similar locations existing or to be implemented by BELL GPCANADA or any other person designated by it.

2 – Currency

All ticket prices for the Event are stated in Canadian Dollars.

3 – Tickets

You agree to purchase and fully pay the price of any ticket ordered, including all applicable taxes and shipping fees, as well as any service fees and other applicable charges, as described in your Order Confirmation (described below), and BELL GPCANADA agrees to sell any ticket detailed in your Order Confirmation.

The purchase of ticket(s) grants the holder a revocable license to attend the Event as described on the ticket(s). No other form of obligation between you and BELL GPCANADA, whether expressed explicitly or implicitly, arises from the purchase of the ticket(s).

Any ticket or pass which is falsified, modified or mutilated is void. Tickets to the Event are not for resale, although they may be transferred. One (1) child aged 11 and under if accompanied by an adult holding or using a General Admission ticket will be admitted free of charge as a General Admission spectator. A proof of age may be required.

By transferring the ticket, you represent and warrant that you have obtained the recipient’s consent to these Terms of Sale.

4 – Order Confirmation

Once your order has been confirmed and your payment has been processed, you will receive an Order Confirmation or an email containing a confirmation number (the “Order Confirmation”). You must save and keep your Order Confirmation.

If, for any reason, you do not receive an Order Confirmation or receive an error message, or if there is a service interruption while you are completing your ticket purchase, you must contact us immediately [contact information] to confirm whether your order has been properly processed. You are solely responsible for any issues reasonably beyond our control that may arise during the ticket purchase process, such as an internet service interruption. In such a case, you agree that BELL GPCANADA shall not be held liable for any loss (monetary or otherwise) that may result.

Orders will be processed only after the address and other billing information have been verified. Errors or inaccurate information regarding billing or credit account details may delay order processing and ticket delivery. You agree that BELL GPCANADA may attempt to contact you using the information provided at the time of purchase. If BELL GPCANADA is unable to reach you after an initial attempt, we reserve the right to cancel any order.

5 – Delivery

Your tickets will be sent to you by email.

6 – Cancellation

BELL GPCANADA reserves the right to cancel the event with no obligation other than to refund the price of the unused portion of the ticket or pass, only upon presentation of such ticket or pass.

No refund shall be made, in whole or in part, of the price of a ticket or pass nor any exchange of a ticket or pass for any reason, including any defect to the giant screens, displacement of grandstands, corporate suites or any other circumstance, other than the cancellation of the Event before its scheduled presentation or if the lead driver has not completed at least two (2) laps without the safety car being deployed.

7 – Cancellation, Modification, or Interruption of the CGV Experience

7.1. Types of Tickets and Available Options

The following products may be offered for purchase on the Event website:

  • “Concert Only” tickets, valid either for a specific day or for all three (3) days of the Event.
  • “CGV Experience” tickets, including access to both races and shows, valid either for a specific day or for all three (3) days of the Event;
  • additional options, which are valid for one day only.

The rules below apply exclusively in the event of a partial or total cancellation of one or more shows of the CGV Experience.

 7.2. Lineup and Artist Substitutions

BELL GPCANADA reserves the right to modify the show lineup, including, but not limited to, the schedule, the order of performances, or the substitution of one artist for another. The substitution of an artist, for any reason whatsoever, does not entitle the holder to any refund or credit.

7.3. Cancellation

The cancellation of an opening act or supporting act does not entitle the holder to a refund or credit, regardless of the type of ticket held, provided that the main event or at least one performance takes place. Notwithstanding any provision to the contrary, on the Sunday of the race, the cancellation of scheduled performances does not entitle the holder to a refund or credit.

 7.4. “Concert Only” Tickets

a) Single-day tickets: In the event of the cancellation of the main concert for which a “concert only” ticket was purchased, the Client may be entitled to a refund of the ticket’s value.

b) Three (3)-day tickets: For “Concert Only” tickets valid for multiple days, cancellations are assessed on a per-show-day basis.

7.5. Additional Options

Any additional option purchased separately from the ticket will be refunded in full if the event to which it applies is canceled.

7.6. CGV Experience Tickets

The following rules apply to CGV Experience tickets, whether they are valid for a specific day or for all three (3) days of the Event:

a. If one or more performances are canceled, any refund or credit is limited to the performance portion of the ticket.

b. The refundable or creditable portion is calculated on a pro-rata basis based on the value attributable to the canceled performance day, determined by the percentage of the headliner’s cost for that day relative to the total cost of the artists included in the ticket.

c. When a CGV Experience ticket is valid for three (3) days and a show scheduled for one of those days is canceled, only the show on that day may be eligible for a refund or credit, calculated in accordance with paragraph b), and limited to the show portion of that day.

8 – Refunds or Credits Upon Request

All sales are final, and refunds are permitted only under the circumstances expressly set forth in sections 4, 5, and 8 of these Terms of Sale or as required by law. Any refund or credit will be granted only upon the Client’s express request, submitted in accordance with the procedures and deadlines provided by BELL GPCANADA.

No refunds or credits will be granted automatically.

9 – Possible Searches and Prohibited Items on the Event Site

To ensure the safety of the venue, you understand and agree that you and your personal belongings may be subject to searches upon entry to the Event. If you choose not to consent to such searches, you may be denied entry to the Event, without a refund or any other compensation.

The following items are forbidden on the Event site:

  • Alcoholic beverage purchased or coming from off-site;
  • Glass items / containers;
  • Coolers and bags larger than the following dimensions: Height: 22.8 cm (9 in) / Length: 45.7 cm (18 in) / Depth: 25.4 cm (10 in)
  • Ladders/stepladders;
  • Firearms, bladed weapons, electric pulse guns and and any other dangerous object;
  • Parasols and other structures which may block other spectators’ view and/or constitute a threat to their safety;
  • Burners and barbecues;
  • All provocative, diffamatory and protest placards or banners.
  • Electrical equipment that requires using a generator;
  • Drones;
  • Animals (except guide and service dogs).
  • Laser pointer

BELL GPCANADA reserves the right to prohibit any item deemed inappropriate, including any item that could interfere with the normal conduct of the Event, and may remove from the Event site any person in possession of such an item.

10 – Alterations to a Corporate Suite

No additions or alterations to a Hospitality Suite nor any use of a Hospitality Suite other that the use outlined by the Agreement will be permitted without the prior written consent of BELL GPCANADA.

Clients are liable for, and shall indemnify BELL GPCANADA and/or any other Beneficiary (hereinafter defined) against, any and all costs relating to any such additions or alterations, including any costs incurred by BELL GPCANADA.

11 – Recording and Filming

Client must not make, create, store, record or transmit any kind of sound recording, visual footage or audio-visual footage, or store, record or transmit any information or other data, including official timing, results, performance, telemetry, weather or race control data of, at, or in relation to the Event.

It is forbidden to take into the Event site any equipment that may enable the Client to do the aforementioned acts. Personal electronic devices (including still image cameras, mobile telephones and other handheld personal communications devices) are permitted within the Event site unless otherwise advised, provided that any recording, data and any image, including photographic images and any still pictures derived or capable of being derived from a recording of the Event that is recorded, stored and/or created thereon is used for personal, private and non-commercial purposes only.

12 – Undertaking

By purchasing a ticket, the Client agrees to the following:

1. (i) the use of any such Recording, Data or Image for any form of public advertisement, display, commercial gain or for any other purpose (except for private enjoyment) without the prior written consent of is strictly forbidden and will constitute a breach of these Terms of Sale for which the ticket holder may be liable; (ii) on request by ORG or FOWC, the Client shall assign to FOWC in writing the copyright and all other intellectual property in any Image or Recording that the ticket holder creates, makes, stores or records of, at or in relation to the Event and (iii) the Client consents to the use by FOWC (and by any third party authorized by FOWC from time to time) for the purposes of or in connection with any publication, exhibition or broadcast (including any advertising or promotional literature, campaign or material) in any media worldwide, without further consent, in perpetuity and on a royalty-free and indemnification basis, and approved by FOWC of any still or moving picture images taken at the Event where such image includes any image of the Client, the Client’s voice or likeness and the ticket holder waives any and all of his/her personality and privacy rights to the extent necessary to permit such use. The Client, on his or her own behalf and on behalf of any accompanying persons (including minors), waives any claim that may arise from the recording of his or her image, voice, actions, and/or statements at the Event venue and from the use and/or distribution of such material for promotional or other purposes;

2. an acknowledgement that motor racing, the Event and certain activities associated therewith (including without limitation, support events) are dangerous and a voluntary acceptance of the inherent and incidental dangers and risks of attending the Event;

3. an exoneration to the maximum extent permitted by law in favour of BELL GPCANADA, the partners of BELL GPCANADA, any company related or affiliated with BELL GPCANADA as well as their respective shareholders, directors, employees, representatives and agents (individually a “Beneficiary”), sanctioning bodies, FIA, FOWC and its affiliates including Formula One Management Limited, Formula One Licensing B.V., Formula One Asset Management Limited, Formula One Hospitality and Event Services Limited, Formula One Marketing Limited, Formula Motorsport Limited, persons involved in the organization of the Event (including officials, marshals, rescue and medical staff), the competitors and drivers (such parties to include where relevant all directors, officers, employees, agents, contractors and affiliated companies), from any liability for any loss, damage or injury howsoever caused which may arise on the site of the Event, whether it is before, during or after the Event and a waiver of any recourse in this regard (save that nothing in these conditions limits or excludes (a) liability for death or personal injury arising out of the negligence of any of the above mentioned parties, or (b) any damage caused directly by gross negligence, incurred by way of fraud or fraudulent misrepresentation of any of the above mentioned parties);

4. an undertaking to adhere to safe, prudent and respectful behaviour and to observe all security regulations and instructions established or posted on the site or given by the officials and an undertaking not to bring on the Event site any dangerous items, failing which he/she shall be subject to expulsion with no refund;

5. an acceptance by every person other than a consumer as defined in the Consumer Protection Act ( R.S.Q., chapter 40.1) that any claim or other dispute between the buyer, the user or any other Client and BELL GPCANADA and/or any other Beneficiary, regarding such ticket or pass, the Event, its running and/or the fact of attending it, shall be submitted to arbitration, excluding any judicial court, which arbitration shall take place in the province of Québec and be governed by the applicable laws in Québec, on an individual and not a collective basis, before a single arbitrator whose decision shall be final and without appeal and will be binding between both parties; and

6. a renunciation by every person other than a consumer as defined in the Consumer Protection Act (R.S.Q., chapter 40.1) to the right to participate to any class action that could be aimed against BELL GPCANADA and/or any other Beneficiary.

13 – Location

BELL GPCANADA reserves the right to determine, in its absolute discretion, the final location of the facilities at the Event including, without limitation, the positioning of the different components of the Hospitality Suite.

The Client acknowledges and agrees that the purchase of a ticket for the Formula 1 Canadian Grand Prix does not guarantee full or uninterrupted visibility of the circuit or the events taking place on the track. Visibility may, without limitation, vary depending on the seat location, temporary structures, weather conditions, crowd presence, or other factors beyond BELL GPCANADA’s control. No refunds, exchanges, or compensation will be provided due to visibility deemed partial, obstructed, or unsatisfactory.

14 – No Advertising or Promotion

1. No advertising or promotion whatsoever by the Client will be permitted in relation to the different components of the Hospitality Suite or the Event, including, without limitation, any corporate advertising sign or corporate identification within or outside the Hospitality Suite, without the prior written consent of BELL GPCANADA.

2. Tickets or passes to the Event, a grandstand, a Corporate Suite, a Villa or any of the different components of the Hospitality Suite cannot be resold or offered for sale for any form of fee or reward without the prior written consent of BELL GPCANADA first being obtained and without complying with these Terms of Sale in all respects.

Tickets and passes for the Event may not be used for advertising, promotional or commercial purposes including without limitation, prizes, competitions, publicity contests or lotteries (sweepstakes) or packaged with hospitality or other products without the prior written consent of FOWC and BELL GPCANADA first being obtained. BELL GPCANADA reserves the right to refuse admission to (or eject from) the Event site, with or without a refund of the ticket price, any person (a) not complying with these Terms of Sale or any other terms, rules, policies, regulations, procedures, and protocols in effect at the Event Site; (b) not in possession of a valid ticket; (c) who is in possession of a ticket which has been sold or used other than in compliance with these Terms of Sale; or (d) on grounds of health, safety, security or maintaining good public order (including undesirable or inappropriate behavior).

3. Unless BELL GPCANADA expressly authorizes it in writing, no person may use the name of the Event or part thereof (nor any abbreviation or foreign language version thereof) nor any logo or graphic device of or relating to the Event for any commercial purpose whatsoever without the prior written consent of FOWC first being obtained exercisable in FOWC’s discretion. Client must not advertise or promote its activities using the BELL GPCANADA name or any event promoted by BELL GPCANADA, in any way that connects the event to Client such that it implies or gives the impression that Client or Client’s activities are endorsed or sanctioned by BELL GPCANADA or that Client is a sponsor or partner, or is in some other way connected to BELL GPCANADA or the Event.

15 – Intellectual Property

Nothing in these Terms of Sale gives any right or entitlement or use of logos or trade-marks or other intellectual properties related to the F1 FORMULA 1 logo, FORMULA 1, F1, FIA FORMULA ONE WORLD CHAMPIONSHIP, FORMULA 1 CANADIAN GRAND PRIX, CANADIAN GRAND PRIX, FORMULA 1 GRAND PRIX DU CANADA, GRAND PRIX DU CANADA and related marks are trade marks of Formula One Licensing BV, a Formula One group company. All rights reserved.

16 – Catering

Client acknowledges and accepts that BELL GPCANADA has the sole rights in respect of choosing all catering, food and beverage services for the Event and may appoint, from time to time, such persons or organisations as it may see fit, in its absolute discretion.

17 – Persons Under 18 Years Old

Client must ensure that any guest, employee or agent who is under 18 years of age is accompanied and supervised at all times by his or her parent or guardian.

18 – Default of Client

If any of the payment terms specified in the reservation form are not met by Client, or if Client commits any breach of the present Terms of Sale or of the agreement with BELL GPCANADA, BELL GPCANADA may terminate the agreement by giving seven (7) days notice to Client. In the event that BELL GPCANADA issues a notice referred to in this clause, the Client is required to remedy to BELL GPCANADA’s satisfaction the breach before the expiry of the notice, failing which the agreement will terminate upon the expiration of the seven (7) days notice. Client agrees in advance that upon termination:

1. Client will forfeit all monies paid to BELL GPCANADA prior to termination.

2. BELL GPCANADA will be free to enter into an agreement with any third party covering any or all of the rights, benefits and entitlements under the cancelled agreement.

3. The forfeit of any monies pursuant to paragraph a) and the termination of the agreement will not preclude any other rights or recourses which BELL GPCANADA may have against Client as a result of the Client’s default including in particular, the right to claim the total payment of the amounts due if it had not been a termination and to claim damages for breach of the agreement.

19. Denied Entry and Eviction ; No Refund

Notwithstanding anything to the contrary, BELL GPCANADA reserves the right to refuse entry to (or evict from) the Event site and take legal action against you, without compensation of refund, any person (a) not complying with the present Terms of Sale or any rules or regulations located or broadcasted on the Event site or other applicable rules, policies, terms, and conditions; (b) who is in possession of a ticket or pass which has been sold or used other than in compliance with the present Terms of Sale; or (c) who, in the opinion of BELL GPCANADA, is under the influence of drugs or alcohol, becomes uncontrollable, is disorderly, uses vulgar or abusive language or engages in inappropriate behavior.

Tickets purchased through this Website are revocable licenses, and admission may be denied to any ticket holder for any reason (or no reason) upon refund of the ticket’s face value, at the sole discretion of BELL GPCANADA. Tickets are not redeemable for cash.

20 – Client Behavior

All Clients are required to behave in a respectful and safe manner and to comply with applicable rules throughout the Event site, including the stands, general admission areas, boxes, terraces, and any other areas accessible to the public. Without limiting the generality of the foregoing:

  • It is forbidden to smoke or vape in the stands.
  • Getting bare-chested is forbidden.
  • Sitting in the grandstand staircases and/or obstructing them is forbidden.
  • Banners, flags and other promotional items are allowed, as long as they do not block other spectators’ view and/or bother them.
  • Remain courteous and patient.
  • Should an incident occur, please report it immediately to the person in charge of the grandstand.
  • You may stand up to take pictures, as long as you do not bother other spectators.
  • It is strictly forbidden to climb or cross fences used to delimit the perimeter of the track.

Any person who refuses or fails to comply with these rules or the instructions of authorized staff may be denied access to the Event site or removed from it, for a specified or indefinite period, without refund or compensation.

21 – Indemnification

You hereby agree to indemnify and hold BELL GPCANADA harmless from any damages, claims, lawsuits, or other demands, including, without limitation, reasonable costs related to any litigation, such as legal fees, arising out of or in connection with (i) your purchase of tickets, or (ii) your participation in the Event.

22 – General

In the event that any or any part of the terms contained in the Terms of Sale shall be determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term shall to that extent be severed from the remaining terms which shall continue to be valid and enforceable to the fullest extent permitted by law.

The headings in these Terms of Sale are included for convenience only and do not form part of the Terms of Sale.
